Please read these Terms of service ("Terms") carefully before using the QPoint website and the QPoint application (the "QPoint") operated by QPoint ("us", "we", or "our").

Your access to and use of the QPoint is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the QPoint.

By accessing or using the QPoint you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the QPoint.

Use of the services

You must follow any policies made available to you within the services.

Don’t interfere with our services or try to access them using a method other than the interface and the instructions that we provide. You may use it only as permitted by law. We may suspend or stop providing our services to you if you do not comply with our terms or privacy policies.

In connection with your use of the QPoint, we may send you service changes (announcements), administrative messages and other information.

Subscriptions

Subscription/payment policy

Some parts of the QPoint are billed on a subscription basis ("Subscription(s)").

We offer you different membership plans for using QPoint and the specific pricing terms depends on what benefits you will be able to use in app. Payment is made at the beginning of your subscription plan. Subscription plan automatically renews every month. If you purchase a subscription, you acknowledge and agree that we are authorised to use payment information on file for renewal. The date that your subscription will automatically renew is provided on your account page and in the payment confirmation email sent after your initial purchase.

Taxes

For European Union customers tax is included in price and it will be displayed on the invoice. Non-european customers are excluded from tax.

Price changes

QPoint may change the price charged for the services at any time, provided that, for QPoint billed on a subscription basis, the change will become effective only at the end of then-current billing cycle of your subscription. QPoint will inform you with prior written notice of any change in price and give you opportunity to cancel or change your membership plan before the change becomes effective.

Subscription cancellation policy and refund

If you are not satisfied with QPoint or if you don’t need our app, you can cancel the subscription plan. We can cancel renewal of subscription plan at any time before that date through account page, or by contacting us. This will stop your subscription charges from accruing to your account. If you missed that date, we can refund your payment within three days of your cancellation.

Content

Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, videos, or other material ("Content").

Since the survey creators are owners of their research, QPoint is not responsible for content (images, video or audio etc.) that survey creators publish.

Links to other websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by QPoint.

QPoint has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that QPoint shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Cookies

QPoint use cookies and similar technologies on our websites. Cookies are small bits of data we store on the device you use to access our services so we can recognize repeat users. Each cookie expires after a certain period. We use cookies and similar technologies to make our site easier to use, for security reasons, to provide you with your personalized content, to improve our services, to advertise to you.

QPoint’s Privacy policy explain what information we collect, how we use information we collect, updating your information, information about security, specific needs of your information, notifying changes and other privacy and security particularities.

By using our services, you agree that QPoint can use such data in accordance with our privacy policies.

QPoint is committed to use your data to comply with the laws, codes, regulations and requirements to protect your rights, security and integrity of personal information.

Security

Information will be safely stored on Microsoft Azure servers which are maintain by QPoint.

Credit card details are managed by third party Braintree a PayPal company.

When you enter sensitive information such as credit card number on our order forms, we encrypt that information using secure socket layer technology (SSL). We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If we decide to change something in our privacy policy we will notify 15 days before the effective date of the changes, by our website or by sending you an email about changes we want to make. What constitutes a material change will be determined at our sole discretion.

If you do not agree to new privacy policy, you have the ability to close your account at any time.

THE SERVICES ARE PROVIDED ON AN "AS IS" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. QPoint MAKES NO WARRANTY THAT (I) THE SERVICES ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR (III) THE RESULTS OF USING THE SERVICES WILL MEET YOUR REQUIREMENTS. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES. IN SUCH JURISDICTIONS, THE FOREGOING DISCLAIMERS MAY NOT APPLY TO YOU INSOFAR AS THEY RELATE TO IMPLIED WARRANTIES.

Limitation of liability

YOU UNDERSTAND AND AGREE THAT THE QPoint PARTIES WILL NOT BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF A TYPEFORM PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM YOUR USE OR ACCESS OF, OR INABILITY TO USE OR ACCESS, THE SERVICE OR THE CONTENT.
